Post-Conviction Relief
Post-conviction relief is the second path after a conviction, and it is a different path from the appeal. An appeal is confined to the trial record. A petition for post-conviction relief under Rule 32 or Rule 33 of the Arizona Rules of Criminal Procedure is filed in the trial court, before the judge who heard the case, and it is built on what the record does not show: facts that were never presented, evidence the jury never saw, and mistakes by the lawyer who tried the case.
Ms. Jakobe has written hundreds of petitions for post-conviction relief. She knows what a colorable claim looks like, how to build the record an appeal never had, and what it takes to earn an evidentiary hearing. That experience is what separates a petition that gets a hearing from one that is summarily dismissed.
